As global entrepreneurs continue expanding into the United States, many nationals from countries without an E-2 treaty look to Grenada’s citizenship program as a potential pathway.

Within the Global Chamber community, we frequently see founders and investors exploring creative cross-border strategies to access the U.S. market. But when it comes to E-2 visas, details matter.

Under the E-2 Visa Reform provisions in the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023, commonly referred to as the “Amigos Act of 2022,” individuals who obtain citizenship in a treaty country through financial investment must demonstrate three years of domicile in that country before qualifying for E-2 classification.

That is significant.

If citizenship was acquired through an investment program, simply holding the passport may not be enough. Applicants may need to prove they actually resided in that country for three years before qualifying for E-2 status.

There is a developing legal argument that citizenship obtained through a government donation, rather than a qualifying investment, may not trigger the same three-year domicile requirement. The structure and basis of how citizenship was obtained could materially affect eligibility.

This is not one size fits all. Strategy, structure, and timing are critical — particularly for globally mobile entrepreneurs operating across multiple jurisdictions.
