What You NEED to Know about Mexico Employment Law Changes

In April the Decree amending, adding and repealing provisions of several Mexican Federal laws, to prohibit outsourcing activities and regulate certain exceptions, was published in the Official Gazette. Several changes were made to laws such as the Federal Labor Law, Social Security Law, Law of the Institute of the National Housing Fund for Workers, Federal Tax Code, Income Tax Law and Value Added Tax Law, among others that WILL IMPACT anyone doing business in Mexico. You MUST learn about these changes RIGHT NOW and act.

Many were predicting this would never happen, but it did. This is a big deal and so it's time to talk with your Mexican counsel or your Mexican labor outsourcing partner.

At the core of this is that the Mexican federal government direction is to overturn the better part of a century of outsourcing which allows the employer to manage labor risk benefits. This runs counter to decades of maquiladora shelter and two entity sole owned outsourcing. 

Aspects of this new reform cut across many Mexican laws and although there may be a backlash from the business community in México, we think it is time to consult your outsourcing partners, consult your Mexican lawyers and ask your accounting firm - ALL OF THEM.

The implementation of this is fast - indeed the first notices in the last 2 weeks were that it was just passing Mexico's Senate and now it appears that this is now a law with some parts having already started.

Speaker Biographies

Michael Patterson - Partner at Spencer Fane LLP. Mike Patterson helps businesses navigate corporate, compliance and securities matters. He has extensive experience in domestic and international mergers and acquisitions, joint ventures, strategic alliances, equity and debt offerings, foreign direct investment, distribution, agency and licensing matters and market entry strategies. He efficiently resolves legal matters by identifying key issues, focusing resources, and executing on a plan. Mike also regularly advises U.S. and foreign clients in connection with the establishment, structuring, and compliance for international operations, including the establishment of international distribution networks. Also known as “Miguel” after a decade-long stint living and working in Central America, he reads, writes, speaks and negotiates in Spanish. In addition, he has done legal work for clients in Canada, Asia, Europe, the Middle East, Africa, Latin America and the Caribbean. 

 

Eduardo Gonzalez - President at 258 Consulting. Eduardo is President of 258 Consulting, helping companies do business between the US and Mexico. Previously he served as Deputy Trade Commissioner of ProMéxico in Phoenix. Mr. González holds a degree in Public Accounting from the Autonomous University of Baja California in Mexico, and holds several certifications in management and risk management. He also has an extensive resume in business promotion within major Mexican companies with international exposure. Additionally, he has vast experience representing the Mexican Government, as he previously served as commercial delegate for Bancomext in The Hague, Netherlands. Recently he served as State Director of the ProMexico office in the state of Baja California.

 

Raymundo Rodriguez - Kastell Consulting. Raymundo Rodríguez Mondragón, 50-year-old Mexican, studied a bachelor's degree in business administration, and specialized in a master degree in administration and organization. Between 1992 and 1999 he was Head of the Unit for the Promotion and Attraction of Investments of the government of the state of Oaxaca, promoting existing competitive advantages within Mexico and abroad for the establishment of investment that generated intensive labor, as well as commercial promotion of mezcal. Between 1999 and 2005, he worked for the FEMSA group in Coca-Cola's carbonated beverages division, as manager of business development and later as head of marketing for the city of Puebla. Since November 2005, he has provided his services for Kastell Consulting Group as Bajío (Center of México) regional manager, serving Queretaro, Guanajuato and a part of the highlands of Jalisco, specializing in business in the financial sector. He has participated actively in the creation of businesses and companies in the region, has promoted landing of foreign investment in Guanajuato and Aguascalientes and has been a consultant in the financial, administrative and marketing areas. Since 2012, He is member of the KCG board of directors.
